Bidders participating in this auction agree to the following:

Bidder will relocate building at own expense. Must provide plan for relocating building within 5 business days following close of auction.

Bidder will relocate the building to a property owned by bidder. Must show proof.

Bidder agrees to apply to the City of Houston to designate the building as a protected landmark or relocate the building to a location within the boundaries of a historic district and must provide a timeline and development plan within 5 business days following close of auction.

Bidder must make application and be granted a Certificate of Appropriateness (COP) in addition to any other required permits (example - sewer disconnect permit issued to a licensed plumber). Go to: http://www.houstontx.gov/planning/HistoricPres/hist_pres.html for more details and/or forms. Note: Structure and site will require much prep work prior to move.

Bidder will secure the services of a "reputable" house mover. Mover must be able to provide verification of workman's compensation and general liability insurance. Interested bidders should start now trying to secure quotes and line-up their desired mover in order to meet time constraints to have building relocated within the 60 day window following close of auction.

Bidder does not assume or commit the City to pay any cost incurred in connection with preparation, transfer, relocation, demolition, reconstruction of the building/property, or in any other un-specified way.

Bidder/Buyer providing false or misleading information, intentional or not, in any documents presented to the City regarding the purchase/transfer/relocation of this property will forfeit any funds applied to purchase process and will forfeit their right to the property as well. In addition, Bidder/Buyer will be blocked from further participation in any City of Houston online auction.

VIEWING OF PROPERTY ARE BY APPOINTMENT ONLY AND MUST BE SCHEDULED AT LEAST 24 HOURS IN ADVANCE.

The Building does not include any concrete slab or the Real Property upon which the Building is located.

Right of Entry and Removal of Building. Buyer acknowledges that time is of the essence, and this Right of Entry expires on the earlier of (i) Buyer's completion of removal of the Building from the Real Property, or (ii) thirty (60) days from the date this auction closes.

Buyer shall give all notices and obtain and pay for all permits, licenses, and bonds which may be required by federal, state, county or city laws for the removal and transportation of the Building, before Buyer enters onto the Real Property to remove the Building from the Real Property. Buyer shall provide the auction agent, Carman VanMeter, with copies of all required permits/ documents before Buyer begins work on removing the Building.

Buyer shall coordinate with auction agent, Carman VanMeter, by telephone at (713) 847-5186 twenty-four (24) hours in advance before entering onto the Real Property.

Buyer shall remove in a good and workmanlike manner the Building and all Building components from the Real Property. Buyer shall remove all debris from the Real Property, including but not limited to all lumber, pipes, conduits, wires, lights, fixtures, and other building materials.

Buyer shall be solely responsible for all damages to any person or property associated with Buyer or Buyer's agents' upon entry onto the Real Property.

Payment must be made within 5 calendar days of the auction's close via Cashier's Check payable to "City of Houston" at the Asset Disposition office located at 2511 Broad St., Houston, TX 77087.

CONDITON NOTES:
Primary (historical) building is wood frame on blocks. There is a concrete block and mortar addition with a concrete slab foundation conjoined to the main house and the roof reconstructed to appear as one building. As advised by a reputable building mover, the buildings will need to be separated and the addition will need to be demolished. It can not be successfully transported as part of the house. The front porch attached to the main house can be left in tact and relocated with building. What was a back porch originally was at some point converted to an enclosed addition to the house and remains part of the main structure. However, as a porch, it slopes down from the level of the main house and may require additional support during transfer. As shown in the photos, there is a large area in the kitchen where the floor has rotted through. That will need some level of repair prior to moving the building. The relocation specialist suggested that it would be best to schedule that work to be done at the time of the actual move when the house is jacked up enough to get under it. There are also several trees that will need to be taken down that rest against the building.

City personnel will take responsibility for any alterations needed to the Real Property site between the area of the building and the access road to make way for the truck, trailer, and house to pull through.

All items are sold as-is, where-is without warranty, expressed or implied. Buyer agrees to indemnify and hold harmless Seller for any and all damages, claims or liability for injuries to persons or property caused during the sale or by the removal of the item.

Items sold must be paid for and picked up within 5 Business days of the close of the auction at the City location indicated, unless otherwise stated in description. Pick up times may vary at each location. Bidder must read the Terms and Conditions for complete information.

Buyer is responsible for inspecting items offered online and all bids must be based solely on the buyer's personal inspection and evaluation of the item.

WE DO NOT SHIP ITEMS, THE WINNING BIDDER IS RESPONSIBLE FOR REMOVAL OF THE ITEM.

No service of any kind will be furnished by the City of Houston. The winning bidder will assume any cost of weighing, packaging, crating, loading or hauling.

Buyers Premium A 9.5% Buyer Premium will be added to the final sale price with a $1 minimum charge per auction to collect payment.

Customers are expected to take all items included in the auction. Abandonment of any items may lead to the customer being blocked.

PayMac handles all payments for City of Houston.

Acceptable forms of payment are: Wire Transfer or Credit Card.
NO CASH, CHECKS, OR MONEY ORDERS WILL BE ACCEPTED!

Payment for an awarded item must be received within five (5) business days after notice of award.
