Loudoun Water makes no warranties or guarantees, expressed or implied, as to the condition or quality of the items offered or fitness for particular purpose or fitness for use in general. The responsibility as to condition of the property rests with the Purchaser. Under no circumstances will a refund or adjustment be made on account of property failing to meet Purchaser's expectations. Sale is "as is, where is" without warranty. There is no guarantee or warranty on the part of Loudoun Water as to condition or quality; or that the property offered, or a portion thereof, may not be withdrawn prior to the sale. Except as stated herein, Loudoun Water will furnish no service of any kind, and the Purchaser shall assume any cost and or liability of removing property from the site.
The Purchaser guarantees to save Loudoun Water, its agents or employees, harmless from liability of any nature or kind in the sale of or purchaser's use of the property.
Applicable Law and Courts: This contract shall be governed in all respects by the laws of the Commonwealth of Virginia and any litigation with respect thereto shall be brought in the courts of the Commonwealth. The contractor shall comply with applicable federal, state and local laws and regulations.

WE DO NOT LOAD, SHIP OR PACK ITEM(S) FOR PICKUP. LOUDOUN WATER EQUIPMENT CAN NOT BE USED TO ASSIST IN LOADING. The pickup of all surplus item(s) purchased is the responsibility of the purchaser (i.e. placing on pallets, forklift, wrapping pallets, etc.) and must be completed by the purchaser and/or their shipping agent, during normal working hours.
Once the auction is complete and Public Surplus has notified Loudoun Water of your cleared payment, please contact Procurement via email, firstname.lastname@example.org, or phone, 571-291-7882, to arrange a pickup date and time.
Pickup's must occur at the specified item location (with receipt and picture ID), between the hours of 9:00am and 2:00pm, Monday through Friday (excluding State observed Holidays). Dutch auctions, item(s) are released on a first come first serve basis after payment is received and notification of pickup arranged.
Loudoun Water employees are permitted to participate in the competitive sealed bidding process for the public sale of Loudoun Water and Commonwealth of Virginia surplus property. Loudoun Water employees and members of their immediate family are prohibited from bidding on individual line items where the bid will exceed the bidding limitations of $500.00. The cumulative value of total line items may exceed the bidding limitations. Where the bid will exceed the bidding limitations, Loudoun Water employee may not have any individual submit a bid on their behalf to circumvent the bidding limitations (Code of Virginia 2.2-4368). Item(s) should be removed from Loudoun Water property within five (5) business days from the close of auction.
Loudoun Water reserves the right to charge a storage fee of $25.00 per item per day in excess of the time allowed.
Winning bidders who default on making payment shall be blocked from all future Loudoun Water auctions.
