BRANCH COUNTY SHERIFF’S OFFICE – VEHICLE AUCTION TERMS

VEHICLE CONDITION – PLEASE READ BEFORE BIDDING

THIS VEHICLE DOES NOT RUN AND IS NOT DRIVABLE. THE TRANSMISSION IS BAD.

The vehicle will need to be towed, trailered, or otherwise transported from the property at the buyer’s expense. The buyer must bring all necessary equipment and personnel required to safely load and remove the vehicle.

This vehicle is being offered for sale by the Branch County Sheriff’s Office and has been previously used. The vehicle is being sold AS-IS, WHERE-IS, WITH ALL FAULTS, with no warranties or guarantees, expressed or implied.

The Branch County Sheriff’s Office and Branch County make no guarantee regarding the mechanical condition, roadworthiness, remaining service life, or fitness of the vehicle for any particular purpose. The known mechanical issue is a bad transmission, and the vehicle does not currently run or drive. There may be additional defects or mechanical issues that are unknown to the Branch County Sheriff’s Office.

Prospective buyers are encouraged to inspect the vehicle prior to bidding.

VEHICLE PICKUP

ALL PICKUPS ARE BY APPOINTMENT ONLY.

The buyer is solely responsible for all costs and arrangements associated with payment, pickup, loading, towing, shipping, and transportation of the vehicle.

Because the vehicle does not run or drive, the buyer must make appropriate arrangements to remove it. The buyer must provide all necessary personnel, equipment, tools, trailers, tow vehicles, winches, or other resources necessary to safely load and remove the vehicle.

Branch County and the Branch County Sheriff’s Office will NOT provide tools, equipment, towing, loading assistance, or personnel to assist with removal of the vehicle.

THIRD-PARTY PICKUP

If someone other than the registered buyer will be picking up the vehicle, the buyer must provide prior written authorization identifying the individual or company authorized to take possession of the vehicle. A copy of the buyer's identification may also be required before the vehicle will be released.

The vehicle will not be released until all required documentation and payment requirements have been satisfied.

INSPECTION AND QUESTIONS

Prospective bidders are encouraged to inspect the vehicle before placing a bid. Inspections and pickups are available by appointment only, Monday through Friday, between 9:00 a.m. and 4:00 p.m. Eastern Time.

Payment for an awarded item must be received within five (5) business days after notice of award.


Branch County may charge sales tax. The tax rate will be calculated at the time of bidding. When sales tax is included, the buyer shall add and include the sales tax amount when making payment.

A Buyers Premium of 10.5% will be added to the final sale price with a $1 minimum charge per auction for payment collections. This premium will be visible during the bidding process and added to the total bid.

All sales are final. Public Surplus will notify buyer of receipt of payment via email.

The successful bidder will be responsible for pick-up of item(s) from the agency's premises. Pick-up must occur within ten (10) business days after notification of award. The notice of award, payment receipt, and personal identification must be presented at time of pick-up, or the item will not be released.
