PayMac handles all payments. Paymac initiates payments to FDACS (Seller) once a week. Items will be available within 7-14 business days upon confirmation of payment received by FDACS. Items will not be released until funds have been received by FDACS from PayMac, there are no exceptions.
Timely payment will ensure timely pickup.

- Pick up -
The notice of award, payment receipt, and personal identification must be presented at time of pick-up, or the item will not be released.


Basic Description
:

The purpose of this auction is to SELL 1 (one) galvanized steel fire tower, with the tower pylons. The Florida Department of Agriculture and Consumer Services (FDACS) intends to only sell the tower and not the property on which the tower is located.

Buyer is responsible for: furnishing proof of liability insurance to the seller; the fire tower must be removed 30 calendar days after payment is received from Florida Department of Agriculture and Consumer Services property.

Bidders are REQUIRED to remove the pylons, along with the tower. Bidders shall cause minimal ground disturbance when removing pylons, as well as return the ground to its previous state, including providing necessary fill dirt.

Approximate Dimensions: This is a 100 ft. tower with a trap door entrance and a standard 6' X 6' ft. or 36 sq. ft. cabin. It was constructed in 1953 of galvanized steel with pressure treated wood steps and cabin floor, currently the wood steps are in poor condition.

An onsite inspection of the tower is recommended. All prospective bidders should perform their own due diligence prior to submitting a bid. Interested bidders may inspect the tower for sale prior to submission of bids. Due to poor conditions and safety concerns of the wood stairs, bidders are not allowed to climb the stair in the interest of safety. Bidders shall contact Patricia McClellan at 850-223-0775 (between 8:30 a.m. and 1:30 p.m. EST) to schedule inspection.

To the best of the department’s knowledge, asbestos materials were identified in the window caulk and the tan sheet vinyl with clear glue. Proper abatement and removal of the asbestos-containing material is the buyer’s responsibility. The department will provide documentation upon request.

ENVIRONMENTAL HAZARD: The Cooks Hammock Fire Tower has been surveyed by GLE Associates, Inc. and their report is attached as “Appendix A”. The tower contains asbestos. By placing a bid, all bidders acknowledge they have read the survey and accept all conditions AS IS. Bidders indemnify and hold harmless FDACS from all claims related to environmental hazards or removal of asbestos. These terms survive the sale.

Removal:

If you are the winning bidder, contact the Seller PRIOR to arriving to verify the location of the item(s) won, and additional instructions.

If there are any issues with the item at removal, resolve them with the Seller BEFORE the item is removed.

The Buyer is responsible for all arrangements, packing, loading, dismantling, and transport. The Seller assumes no responsibility for packing, loading, or shipping.

Guaranty Waiver. All property is sold 'AS IS, WHERE IS.' FDACS makes no warranty or representation of any kind. All sales are final after removal.

Seller warrants the property will conform to its description. Claims must be made before removal. If misdescribed, Seller will keep the property and refund the purchase price. Liability shall not exceed the purchase price.

Items will be available within 7 - 14 days upon confirmation of payment received by FDACS. Title to item(s) paid in full will not pass to the successful bidder until bidder actually receives and takes possession of the item(s) at the mutually agreed upon pick-up time.

Successful bidder is responsible for packing and loading all item(s) at pick-up.
